THIS CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU AND 9536-5110 QU\u00c9BEC INC. OPERATING AS SPIN LAB.<\/p>\n
PLEASE READ IT CAREFULLY BEFORE USING THE SPIN LAB WEBSITE OR SERVICES.<\/p>\n
These Terms and Conditions, including the Rider Agreement attached as Schedule A to these Terms and Conditions, govern your relationship with 9536-5110 Qu\u00e9bec Inc. operating as Spin Lab, also referred to as Spin Lab, we, us, our.<\/p>\n
This Agreement applies to your use of the Spin Lab website and any booking or purchase of Spin Lab memberships or classes, your right to cancel purchases where consumer protection laws apply, your purchase of merchandise, your communications with Spin Lab, your use of and attendance at our Spin Lab studio in Montreal Quebec, and all services we provide in connection with the above, collectively the Services.<\/p>\n
If you choose to purchase Spin Lab memberships or classes online, this Agreement sets out certain rights you may have under consumer protection laws to cancel that purchase. By visiting or using our website or using any of our Services, you agree to be bound by these Terms and Conditions and you agree that we may collect, use and disclose your personal information as described in our Privacy Policy. If you do not agree, do not use our website or Services.<\/p>\n
When you visit or use our website, or communicate with Spin Lab by email or through Mariana Tek, you are communicating electronically. You consent to receive communications from Spin Lab electronically, including by email and by posting notices on our website or booking platform. You agree that electronic communications satisfy any legal requirement that such communications be in writing.<\/p>\n
We may modify, revise or update these Terms and Conditions at any time by updating this posting. Each time you use our website or Services, the version then posted will apply to that use. You should review these Terms each time you use the website.<\/p>\n
The contents of our website are owned by Spin Lab or are made available to you under license from third parties. While we allow you access to our website, you acknowledge that your use is governed by applicable intellectual property laws. You may view, electronically copy, and print portions of the website solely for personal use related to booking classes, making purchases, or other personal, non commercial use.<\/p>\n
Any other use of materials on the website, including modification, distribution, reproduction, republication, scraping, or commercial use, without prior written permission from Spin Lab, is prohibited.<\/p>\n
We do not grant any express or implied right to you to any content under any intellectual property laws, including patent, copyright, or trademark.<\/p>\n
You are prohibited from violating or attempting to violate the security of the website, including accessing data not intended for you, logging into an account you are not authorized to access, probing or scanning for vulnerabilities, attempting to breach security or authentication measures, or interfering with service to any user, host, or network, including by submitting malicious code or engaging in flooding, spamming, or crashing.<\/p>\n
Violations may result in civil or criminal liability. We may investigate occurrences that may involve such violations and may cooperate with law enforcement authorities.<\/p>\n
You are prohibited from posting or transmitting to or from us any unlawful, threatening, defamatory, obscene, pornographic, or other material that violates any law.<\/p>\n
The sender of any communication to us is responsible for its content, including its truthfulness and accuracy.<\/p>\n
In your communications with us or postings on the website, please keep in mind that we do not seek unsolicited ideas or materials for products or services or suggested improvements, collectively Unsolicited Ideas and Materials. We may use or copy all or part of any Unsolicited Ideas and Materials you post or send to us for any purpose, including developing or marketing goods or services, without compensation to you.<\/p>\n
Any personal information included in electronic communications to us is governed by our Privacy Policy.<\/p>\n

You assume all risk associated with viruses or other harmful components. You should take precautions before accessing the website.<\/p>\n
To the fullest extent permitted by law, Spin Lab is not liable for loss, damages, or injury arising directly or indirectly out of the use or unavailability of the website, even if advised of the possibility.<\/p>\n
Registering a user account To purchase memberships, classes, or class packages, you must create a user account through Mariana Tek or another Spin Lab approved booking interface. You are responsible for maintaining the confidentiality of your login credentials. You agree to provide true, accurate, current, and complete information and you may not misrepresent your account information.<\/p>\n
You agree not to disclose your password to any third party. You are solely responsible for all activities that occur under your account. If you become aware of unauthorized use, you must notify Spin Lab promptly.
By providing your email address, you agree to receive required notices electronically to that email address. You are responsible for keeping your email address current.<\/p>\n
If you request deletion of your account, it may be deleted and may not be accessible for reactivation, subject to record retention requirements under applicable law.<\/p>\n
If you are under the age of majority in Quebec, you may not create an account or purchase online without the consent of a parent or legal guardian, except as permitted by Spin Lab in accordance with applicable law and our policies.<\/p>\n
Spin Lab may allow minors aged twelve years and older to attend classes if the minor meets Spin Lab participation requirements and a parent or legal guardian has completed the required waiver and consent documentation, whether electronically or in studio.<\/p>\n
You can purchase Spin Lab memberships, classes, or packages online through Mariana Tek, and where available, in person at the studio.
To book a class, you must have an active membership, class credit, or package credit.<\/p>\n
Offerings, prices, and expiration terms are displayed at time of purchase. Memberships, classes, and packages may expire as indicated in your account or at time of purchase.
Prices are subject to change. Spin Lab will honour the price you paid for your current purchase for its term. Renewal pricing may change.<\/p>\n
If Spin Lab offers gift cards, gift cards do not expire unless otherwise required or permitted by law. Once a class or membership is purchased using a gift card, the class or membership is subject to the normal expiry and booking rules displayed at purchase.<\/p>\n
Payments Spin Lab accepts electronic payments only, including credit card and other payment methods supported by Mariana Tek. Spin Lab does not accept cash.<\/p>\n
You authorize Spin Lab and its payment processors to charge your selected payment method for purchases and any applicable fees described in these Terms.<\/p>\n
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Spin Lab, its directors, officers, employees, contractors, agents, affiliates, and related entities from and against claims, actions, demands, and reasonable legal and accounting fees alleging or resulting from your use of the website or Services, your breach of these Terms, or your violation of any law or the rights of a third party. We will provide notice of a claim where reasonably possible.<\/p>\n
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable in Quebec, without regard to conflict of laws rules. Any action relating to these Terms must be brought in Montreal, Quebec, and you consent to the jurisdiction of those courts, subject to mandatory consumer protection rules that may apply.
Entire agreement<\/p>\n
These Terms and Conditions constitute the entire agreement between you and Spin Lab with respect to the website and Services and supersede prior agreements or understandings to the extent permitted by law.
Severability<\/p>\n
If any provision is unlawful, void, or unenforceable, it is severed and the remaining provisions continue in full force.
No waiver<\/p>\n
If Spin Lab does not enforce a right or provision, that is not a waiver of that right or provision.<\/p>\n
Spin Lab uses a 12 hour cancellation policy unless your purchase terms indicate otherwise.<\/p>\n
If you cancel your bike reservation at least 12 hours before class start time, your credit will be returned to you.
If you cancel within 12 hours of class start time, your credit will be forfeited.<\/p>\n
Unlimited memberships and promotional unlimited offers<\/p>\n
If you are on an unlimited plan and you cancel within the 12 hour window, Spin Lab may charge a late cancellation fee of 25 dollars plus applicable taxes.
If three unpaid late cancellations or no shows accumulate on an unlimited plan, the plan may be frozen until charges are paid.<\/p>\n
If you do not cancel within the cancellation window and fail to attend, your class credit will be forfeited.<\/p>\n
Unlimited plans may be charged a no show fee equal to a single class rate plus applicable taxes or another fee disclosed at purchase.<\/p>\n
If three unpaid no shows accumulate, booking privileges may be suspended until charges are paid.<\/p>\n
Up to 1 hour before class If a class is full, you may join the waitlist if you have an available credit. When a spot becomes available, you may be automatically moved into the class based on your position in the queue, up to one hour before class begins. You will receive confirmation by email.
By joining the waitlist, you agree you intend to ride if moved into the class. If you do not want to be moved into the class, you must remove yourself from the waitlist before you are added.
If you are booked for another class and you are moved from a waitlist into a different class, you may be charged for both reservations.<\/p>\n
Standard cancellation policy applies once you are added to the class.<\/p>\n
Within 1 hour of class Within one hour of class, Spin Lab may manage waitlists in studio at its discretion. If we contact you to offer a spot, you must respond promptly to accept.<\/p>\n
Within 30 minutes of class If a class is full, Spin Lab may offer a walk in waitlist on a first come first served basis in studio. Phone or message requests may not be accepted.<\/p>\n
We recommend arriving at least 15 minutes before class. For safety reasons, Spin Lab may refuse late entry and may release your bike to the waitlist if you are not present by the class start time. If you are refused entry due to lateness, standard late cancel and no show rules may apply.<\/p>\n
If Spin Lab offers bike change requests, ask the front desk before class. Reallocation may occur shortly before class start time and is not guaranteed.<\/p>\n
This Rider Agreement is a legally binding agreement between 9536-5110 Qu\u00e9bec Inc. operating as Spin Lab and you. It governs your purchase and use of Spin Lab memberships and classes, your booking of classes, your communications with Spin Lab, your use of and attendance at the Spin Lab studio in Montreal Quebec, and all related services.<\/p>\n
As described in the Terms and Conditions, communications may be provided electronically and satisfy writing requirements.<\/p>\n
You must be the legal age of majority in your province of residence and capable of entering into this agreement. If you are a minor, a parent or legal guardian must review and agree on your behalf and complete the required waiver and consent documentation, as applicable.<\/p>\n
Spin Lab operates one studio in Montreal Quebec. Your purchases are valid for use at this studio only unless Spin Lab states otherwise in writing.<\/p>\n
Membership options may include monthly recurring memberships or fixed term memberships. By purchasing a membership, you agree to pay the amounts displayed at purchase for the duration of the membership term, including recurring payments if applicable.<\/p>\n
Except where required by law, there are no refunds of membership payments or class payments.<\/p>\n
Classes and packages must be prepaid. Purchases are non transferable and may not be shared.<\/p>\n
If you are medically unable to attend classes, you may request a medical freeze of eligible memberships for up to six months, subject to Spin Lab approval and proof such as a doctor\u2019s note. Spin Lab may verify documentation where permitted by law. You must notify Spin Lab when you are ready to return. After a freeze ends, billing may resume and the term may continue according to your plan rules.<\/p>\n
Non medical freezes may be offered at Spin Lab\u2019s discretion and may have additional conditions.<\/p>\n
Spin Lab may adjust freeze policies from time to time.<\/p>\n
Your cancellation rights under consumer protection legislation If Quebec consumer protection laws apply to your purchase, you may have cancellation rights for certain prepaid service contracts. Where applicable, you may cancel within the legal time period after receiving a written copy of the agreement, and refunds will be processed within the timelines required by law.<\/p>\n
To cancel where a legal cancellation right applies, you must provide notice to Spin Lab by a method that allows you to prove the date of notice.<\/p>\n
Prices and expiration dates are displayed at purchase and in your account. You must pay before booking.<\/p>\n
Spin Lab accepts electronic payments supported by our booking platform. Spin Lab does not accept cash.<\/p>\n
Classes may take place in dim lighting and may include flashing or changing lights. Exposure to flashing lights may aggravate certain conditions. Consult a physician if you have concerns and do not attend if you believe you may be at risk.<\/p>\n
Spin Lab will make reasonable efforts to accommodate service animals as required by applicable law. Please contact us in advance so we can plan appropriately.<\/p>\n
In order to attend Spin Lab classes, you acknowledge and agree:<\/p>\n
You recognize there are risks of physical injury, including serious injury, associated with indoor cycling and related activities. You confirm you have no condition that would make participation unsafe, and you have consulted a physician if needed.<\/p>\n
You agree to assume responsibility for injuries, damages, or loss you may sustain as a result of participating, except to the extent caused by Spin Lab\u2019s gross fault or as otherwise required by law.<\/p>\n
You release and discharge Spin Lab, its directors, officers, employees, contractors, agents, and representatives from liability, claims, damages, or losses arising out of participation, to the fullest extent permitted by law.<\/p>\n
You agree you will not attend class if you feel unwell and you acknowledge Spin Lab may ask you to leave if you appear unwell or if your participation presents a safety risk.<\/p>\n
You acknowledge there are no refunds or exchanges for purchases except as prescribed by law and that memberships, classes, and packages may not be transferred or shared.<\/p>\n
To the maximum extent permitted by law, the Services are provided as is and as available. Spin Lab disclaims warranties to the extent permitted by law, including implied warranties of fitness for a particular purpose and merchantability.<\/p>\n
To the maximum extent permitted by law, Spin Lab is not liable for indirect, consequential, special, exemplary, punitive, or incidental damages arising out of your use of the Services. Where limitation is not permitted, Spin Lab\u2019s liability is limited to the amount you paid for the applicable service, subject to mandatory legal rules.<\/p>\n
This Rider Agreement is governed by the laws of Quebec and applicable federal laws of Canada. Any action must be brought in Montreal Quebec, subject to mandatory consumer protection rules.<\/p>\n
